02 · Purpose of the Terms

These Terms of Use (the « Terms ») define the conditions for accessing and using the posnex.ma website (the « Site »), published by SOFTNEXIA SARL (« SOFTNEX »).

The Site's purpose is to present the IT services and solutions offered by SOFTNEX and to let users get in touch with the company via a dedicated form.

03 · Access to the site

The Site is freely accessible to any user with Internet access.

SOFTNEX strives to provide continuous access to the Site but does not guarantee permanent availability. Access may be suspended, interrupted or limited without notice, in particular for maintenance, security or force-majeure reasons.

04 · Intellectual property

The Site and all its content (texts, images, logos, graphics, icons, videos, software, architecture, etc.) is protected by applicable intellectual-property laws and belongs exclusively to SOFTNEX.

Any reproduction, representation, modification, distribution or exploitation, in whole or in part, of the Site or its content, without SOFTNEX's prior written authorization, is strictly prohibited.

05 · Site content

The information on the Site is provided for indicative and informational purposes.

SOFTNEX strives to keep the published information accurate and up to date but does not guarantee its completeness or the absence of errors. SOFTNEX reserves the right to modify, correct or remove the Site's content at any time, without notice.

The Site does not use any tracking, analytics or advertising-targeting cookies.

No cookie is placed on the user's device for the purpose of collecting personal data. The Site may, however, use strictly technical cookies necessary for its proper operation. These cookies do not identify the user and are not used for commercial or statistical purposes.

08 · User responsibility

The user undertakes to use the Site in compliance with applicable laws and regulations and with these Terms.

In particular, the user shall refrain from:

• Any attempt to compromise the security or proper operation of the Site;
• Transmitting unlawful, defamatory or malicious content via the contact form.

When subscribing to a paid plan, the user undertakes to pay the amounts due within the stated deadlines and shall refrain from any maneuver, circumvention or action intended to avoid or delay payment of the subscription.

09 · Limitation of SOFTNEXIA's liability

SOFTNEX cannot be held liable for direct or indirect damages resulting from the use or impossibility of using the Site. SOFTNEX does not guarantee that the Site is free of errors or interruptions. SOFTNEX's liability cannot be engaged in the event of force majeure or events beyond its control.

SOFTNEX cannot be held liable for:

• Temporary interruptions or unavailability of the site,
• Any damage resulting from the use of the site,
• Content published on third-party sites accessible via external links,
• Any technical incident beyond its control.

10 · External links

The Site may contain links to third-party sites. SOFTNEX has no control over these sites and disclaims any responsibility for their content, operation or data-protection practices.
